'Supreme Court order against democracy,' claims Delhi CM Arvind Kejriwal after setback from apex court in Delhi vs Centre row
After a setback from the Supreme Court in the Centre vs Delhi logjam, CM Arvind Kejriwal has said that the verdict of ‘Supreme Court is against democracy’ and his government will be seeking legal remedy over it.
In a blow to the AAP, the apex court today held that Anti-Corruption Bureau, inquiry commission would be outside the purview of the Delhi government and on ‘Services’ and transfer of bureaucrats, the split decision has maintained the ambiguity and will be heard by a 3 judge bench later on.
Arvind Kejriwal, in a press conference today said, “If a government can't even transfer its officers, how is it supposed to function? The party that has 67 seats doesn't have the rights but the party who won 3 seats has those rights.”
Lawyer Ashwini Upadhyay briefed the media after the court’s verdict, “Supreme Court took decision on 6 issues. SC ruled in favour of centre in 4 of them. Anti-Corruption Bureau, posting & transfer of Grade 1 & Grade 2 officers, Commission of Inquiry, falls under Centre's jurisdiction.”
Now, as the issue will create a buzz in the upcoming Lok Sabha polls, Arvind Kejriwal was asked about his alliance with the Congress and being a part of the Grand Alliance, he replied, “Hamare man mein desh ko leke bahut jyada chinta hai... Usi wajah se hum lalayit hain. Unhone (Congress) lagbhag mana kar diya hai.”
The Constitutional validity over the tussle of power between the Delhi government and the Centre would be significant as stated in today’s judgement by Justice AK Sikri and Justice Ashok Bhushan but politics cannot happen in vacuum over the fallout of such verdict.
