UK woman sues mother's doctor for allowing her to be born

A 20-year-old woman sued her mother’s doctor for letting her to give birth to the child and won millions in damages.

The woman, identified as Evie Toombes, who suffers from spina bifida (spinal defect)and spends her days affixed to tubes, claimed that had her mother been advised, she would not have been born.

The woman said that if her mother’s doctor had advised her mother to take follic acid supplements in order to reduce the risk of the spinal defect affecting the baby, she would have slowed down her pregnancy and Evie would have never come to this world.

Judge Rosalind Coe QC supported the woman’s case and, in a milestone verdict in the London High Court, ruled that had her mother been properly advised, she would have delayed her pregnancy.

"In the circumstances, there would have been a later conception, which would have resulted in a normal healthy child," the judge ruled, awarding the 20-year-old rights to millions in damages.

"I was advised that if I had a good diet previously, I would not have to take folic acid," Evie's mother told the court, supporting her daughter's claim.

The 20-year-old, Evie Toombes is a showjumper and has competed against both disabled and able-bodied riders.
