BJP govt blocks proposal for appointment of Jammu and Kashmir's Advocate General as judge, SC collegium asks 'why'

The BJP government has again become a watchdog in the appointment of judges and has gone against the recommendations of the Supreme Court led collegium, where the proposal was to elevate the Advocate General of Jammu and Kashmir as judge.

In April last year, the collegium under then CJI Dipak Misra had cleared the name of Senior Additional Advocate General Wasim Sadiq Nargal as a judge in the Jammu and Kashmir High Court.

In the last meeting of the collegium, headed by Chief Justice Ranjan Gogoi, which was held on January16, said, “As regards Shri Wasim Sadiq Nargal, Advocate, consideration of the proposal for his elevation is deferred for the present. Meanwhile, Department of Justice be requested to furnish specific information in detail on the basis of which the proposal for elevation of Shri Nargal has been referred back for reconsideration by the collegium.”

It was in April 2018, when the collegium was headed by then CJI Dipak Misra, Justice (retired) J Chelameswar, current CJI Ranjan Gogoi after discussion had recommended that Nargal, Advocate Nazir Ahmed Beig, Assistant Solicitor General Sindhu Sharma and Judicial Officer Rashid Ali Dar be appointed as Judges of the Jammu & Kashmir High Court.

The collegium’s recommendation has been changed again, as earlier the collegium has declined to elevate the Delhi High Court Chief Justice to Supreme Court and chosen junior judges, who superseded 32 judges in seniority.
