Tamil Nadu advocate moved the Supreme Court on 24 October against a Madras High Court order forbidding a probe on former Tamil Nadu chief minister J Jayalalithaa's death.
The lawyer, Joseph sought the apex court's direction for constituting a commission by a retired judge.
Joseph urged the state assembly to decide on formation of the probe enquiry commission.
In September, retired Madras High Court judge Justice A Arumugasamy was appointed to probe the death of Jayalalithaa after the present chief minister E Palaniswamy announced that a judicial probe would be ordered in the matter.
