As the President signed the new 10% Reservation Quota Bill, it was enacted as law and Gujarat government has stated that it will implement the law from today itself.

In a ‘game-changing’ move by the Prime Minister Narendra Modi, who successfully passed the Bill with the support of the Opposition, has given a 10% reservation to the General category of economically backward people.

Chief Minister of Gujarat, Vijay Rupani, has said that “Happy to state that the Government Of Gujarat has decided to implement 10% EWS reservation benefits from 14th January, 2019. It will be implemented in all ongoing recruitment process too wherein there is only Advertisement published but first stage of examination is yet to held.”

Earlier, the Gujarat government had passed a similar Bill where the state had given a 10% reservation to the agitating Patidar community which was later on struck down by the Gujarat High Court, which had taken a view stating that the Constitution does not allow quota on the economic basis.

Although, the government’s new law has been challenged in the Supreme Court by an NGO, Youth For Equality which claims that the new law breaches the Supreme Court’s 50% reservation quota and economic basis cannot be the sole criteria to finalize the reservation for a class or caste present in the society.

Meanwhile, Indira Sawhney, an advocate who had famously won a case in 1991 against the Union of India and Supreme Court had then put a cap on reservation with 50% maximum limit, has said that she would be approaching the apex court in the matter.
