Chief Justice of India has given nod to suspend the Railway Claims Tribunal judge RK Mittal, who has come under the scanner for allegedly getting involved in a Rs 50 crore scam related to the compensation claims in Patna.
The file of this case had been pending since last CJI was in the office but it never moved for months. Now, the recently adjudged Chief Justice Ranjan Gogoi has cleared the file in weeks of his taking the office, and has gives a green signal to the Railway Board, the sources confirmed to The Indian Express.
This would be the first case in itself that a sitting RCT judge will be facing a suspension over corruption charges. After the scam came to the highlights and was being reported by the media, Mittal was transferred from Ranchi’s RCT to Trivandrum, earlier this year. RCT chairman Justice K Kannan had already written a few months ago to the Railway Board chairman regarding the suspension of Mittal.
The Railway Board went on to take a legal opinion in the matter about the sitting judge, as he cannot be suspended without CJI’s approval. Hence, the file was then sent to the Chief Justice’s office.
The former Chief Justice Dipak Misra had not cleared the file of Judge Mittal which was lying in his office for months. Opposition had attempted to impeach the Justice Misra over his incompetence to carry out the work and duties of the chair.
The investigation in the case had found that Mittal as judge of the Patna bench had given compensation of amount Rs 50 crore to some victims who are fictious in nature.
